Swiss Ambulance Rescue SA is the only company authorized to sell items connected to its brand unless there is an agreement of partnership established in advance.

Online sales services are destined for retail only.

Before confirmation, these general terms and conditions must be entirely consulted and irrevocably agreed to, and will be considered as such after confirmation of the purchase order. 

Article 1.    Authorization – Preliminary declarations

The buyer / customer declares that:

  • They are legally an adult
  • They possess the full legal capacity to use these services
  • They are fully informed that written consent is unnecessary to assume responsibility for understanding the content of the general terms and conditions and to confirm purchase order
  • All information provided on this website by the customer is correct
  • They authorize the website to communicate with them via the email address provided by the customer
  • All purchased products are destined for personal use only

Article 2.   Definitions

The terms for the parties have the following meanings below:

  • “Item”: the Product(s) that is/are part of the purchase order
  • “Purchase order”: the Product(s) requested from the buyer to the seller
  • “General Terms and Conditions for Online Sales”: the present general terms and conditions of sale, including the introduction
  • “Delivery times”: the period of time between confirmation of the purchase order and delivery date of the buyer’s purchase order
  • “Shipping fees”: the cost of charges applied by the seller to send the purchase order to the delivery address indicated by the customer;
  • “Delivery”: dispatch of customer’s item;
  • “Shipping method”: designates all standard or express shipping methods available on the website at time of the purchase order;
  • “Price”: the single value of a Product; this value includes all taxes and excludes all Shipping Fees;
  • “Total price”: the total amount of accumulated Prices of Products within the Purchase Order; this amount includes all taxes;
  • “Product”: the term designating the product that is for sale on the website;
  • “Website”: online sales website used by the seller to market their products;
  • “the Seller”: Swiss Ambulance Rescue SA;
  • “Online Sales”: marketing of the Seller’s Products via the Website.

Article 3.   Purpose

The purpose of the present General Terms and Conditions for Online Sales is to define the rights and obligations of the parties within the sales of the items marketed on the Website.

Purchasing an item by the buyer signifies complete and full acceptance of the present General Terms and Conditions for Online Sales, which have been fully considered before purchase order.

Article 4.   Scope

The present General Terms and Conditions for Online Sales are reserved for private use of the customer only.

The key features and the prices of the products sold by electronic means are available on the website.

The present General Terms and Conditions for Online Sales are applicable to all product sales by the seller, occurring through use of the website.

The present General Terms and Conditions for Online Sales are applicable to successfully completed purchase orders.

Article 5.   General Terms and Conditions for Online Sales Opposition rights

The 2 parties acknowledge that their relationship will be exclusively ruled by the present General Terms and Conditions for Online Sales, excluding all conditions previously available on the Seller website.

Swiss Ambulance Rescue SA reserves the right to modify the present Terms and Conditions for Online Sales at any time, by publishing a new version on the Website. The Version shall prevail immediately upon online publication.

Article 6.   Accessing the online sales space

Swiss Ambulance Rescue SA reserves the right to temporarily or definitively close down the Website or access to one or more of its many services, such as the online sales space, without notice or liability.

Article 7.   Purchase order, steps to conclude online sales

The Customer must follow a series of steps, specific for each Product offered by the Seller, to carry out purchase order. Nonetheless, the following steps are automatic:

Information on the Product’s key features;

Choice of Product, options (in cases of need), and relaying of Customer’s essential data (identification, address, etc.)

Accepting the present Terms and Conditions for Online Sales.

Verification of the purchase order and correction of errors in cases of need ➢ Follow payment instructions, and payment of products. ➢ Shipping of products. The Customer will then receive a purchase order payment confirmation by email as well as an acknowledgment of receipt of the purchase order. The products will be delivered to the address indicated by the Customer, for all delivered products.  For the purpose of a successful purchase order, the Customer commits to providing their truthful identification. The Seller reserves the right to refuse sale of the purchase order, for example in cases of any abnormal request, orders accomplished by deceitful means, or for any other legitimate motive.

Article 8.   Price

The price of the products for sale on the website is appropriately indicated by item and reference.

All purchase orders are to be paid in CHF (Swiss franc).

During purchase order confirmation, the price to pay is included under the Total Price.

The offers and price confirmation duration is determined by the updating of the Website.  The seller reserves the right to modify prices at any time, but the products will be invoiced according to the cost indicated during registration of the purchase order.

Article 9.  Conditions of payment

The customer’s payment may only be carried out by credit or debit card or Paypal.

Accepted credit or debit cards are mentioned on the website during the time of purchase order. The seller reserves the right to change the accepted credit or debit cards at any time.

After confirmation of the appropriate data, the transaction is immediately charged on the customer’s credit or debit card, following reception of charge authorization by the company issuing the customer’s credit or debit card.

Conforming to the Swiss law in effect, all commitments to pay by credit or debit card are irrevocable. By relaying their credit or debit card information, the customer authorizes the seller to charge their credit or debit card with the amount corresponding to the Total Price.

In this respect, the customer confirms that they are the cardholder to be charged and that the name on the credit or debit card corresponds to that of the customer. The customer relays the sixteen numbers of their credit or debit card and its expiration date, in addition to the security code in cases of need.

Payment by credit or debit card prompts an authorization hold, an automatic request to clear the transaction. All transaction refusals, regardless the cause, entail cancellation of the Purchase Order.

The bank transaction by credit or debit card, undertaken between the customer and the seller’s website, is secured and therefore fully encrypted and protected.

Article 10.  Shipping of purchase order

10.1.   Shipping locations

The sale of Swiss Ambulance Rescue items is limited to Switzerland only. 

10.2.   Shipping method

The shipping method is chosen by the customer during confirmation of the purchase order. 

10.3.   Shipping address

The customer is responsible for specifying and confirming the shipping address. The customer is liable for any shipping errors that are due to the lack of necessary information during a purchase order. 

10.4.   Cost of shipping fees

The shipping fees depend on the amount of the purchase order and the shipping method chosen, and  are subject to confirmation by the customer. 

10.5.   Delivery times

For all conditions and information, please refer to the information specified on the website www.Nescens. 

10.6.   Inspection of the purchase order upon delivery

The customer is responsible for inspecting the state of the packaging and items within a period of 48 hours after reception of the package.

All complaints must be sent by registered mail within 48 hours.  Failure to file a complaint outside the period aforementioned annuls any actions against the carrier and/or Swiss Ambulance Rescue.

The customer must make sure that the products delivered correspond to the purchase order.  In the case of product(s) failing in nature or quality to the delivery order’s mentioned specifications, the customer must inform Swiss Ambulance Rescue’s client services by email at and send the product(s) to the address indicated in the conditions of Article 11 below.

Article 11.  Right of withdrawal

Conforming to the Swiss law in effect, the customer has a period of 10 business days, including the day of package reception, to exercise their legal right of withdrawal.

The customer that wishes to exercise their right of withdrawal must return the items within the aforementioned period in their original packaging, to the following address:

Reimbursement will be carried out without delay, and at the very latest 30 days after Swiss Ambulance Rescue’s reception of the package.

Article 12.  Data protection and rights

The information asked of the customer is necessary in order to process the purchase order, and in the event that the customer relays their personal information, they equally possess the right to access, rectify, and remove this data.

The customer can also oppose third-party transfers of this data by written request to the Seller through the email address or by registered mail to the following address:

The seller reserves the right to use this personal data for the purpose of sending promotional offers. 

Article 13.  Intellectual property rights

Swiss Ambulance Rescue brand, its figurative mark, trademark, and any other mark such as its illustrations, images, or logos on its products, accessories, or packaging, whether or not they are removed, are and reside exclusive property to Swiss Ambulance Rescue, its affiliated companies, partners, or licensed manufacturers.

All total or partial reproduction, modification, or use of its marks, illustrations, images, and logos, regardless of the means or the methods used, is strictly prohibited, except under prior written authorization by Swiss Ambulance Rescue SA.

Altogether, the customer is prohibited from directly or indirectly infringing upon the property rights of Swiss Ambulance Rescue SA.

Article 14.  Force majeure

The seller’s present contractual obligations may be suspended in the event of unforeseen circumstances or in cases of force majeure which prevent or delay execution of these obligations. The seller will thereby notify the customer of the occurrence of such an unforeseen circumstance or force majeure within fifteen days from occurrence of the event date.

If the suspension of the seller’s contractual obligations exceed the 15-day period, the customer can cancel the current purchase order and the seller will proceed to reimburse the purchase order as indicated in the conditions within Article 11.

Article 15.  Non-waiver

The failure of one of the Parties claiming commitment to any of the obligations mentioned herein will be interpreted for the future as a waiver of the obligation in cause.

Article 16.  Invalidity of a contract clause

If one of the provisions of the present Contract has been withdrawn, this invalidity will not lead to the invalidity of other provisions of the Contract, which will continue to be enforced between the Parties.

Article 17.  Law

The online sales and the present terms and conditions for online sales are presided over by Swiss federal law.
